1. Introduction
This document sets out the General Terms and Conditions (hereinafter, "T&C") under which users of the OlaCar platform, operated by OlaCar LLC, access and use the peer-to-peer vehicle rental services available at olacar.app.
OlaCar acts exclusively as a technological intermediary between Hosts (vehicle owners) and Drivers (persons who rent the vehicle). OlaCar does not own the vehicles listed on the Platform, nor is it a party to the rental contract between Host and Driver.
By registering on the Platform and by making or accepting a booking, the user agrees to be legally bound by these T&C, the Privacy Policy and the other policies published on the Platform.
2. Definitions
For the purposes of these T&C, the following terms shall mean:
- Platform: the OlaCar digital platform accessible at olacar.app and all associated technological tools.
- OlaCar / the Company: OlaCar LLC, a company incorporated in the United States of America.
- Host: a natural or legal person who lists one or more vehicles for rental through the Platform.
- Driver: a natural person who books and uses a vehicle listed by a Host through the Platform.
- Additional Driver: a person expressly authorized by OlaCar to drive the vehicle within the framework of an active booking, in addition to the Main Driver.
- Main Driver: the Driver who made and paid for the booking.
- OlaTrack: telematics and vehicle identification device owned by OlaCar, installed in the vehicles listed on the Platform.
- Booking: a confirmed agreement between Host and Driver through the Platform for the rental of a vehicle for a specified period.
- SURA: the insurance company that provides the coverage policy applicable to the rentals carried out through the Platform.
- U.R.: Unidad Reajustable (Indexed Unit), a unit of value measurement established by Uruguayan legislation.
3. Participating parties and legal entities
The Platform is operated by OlaCar LLC. In Uruguay, operations are managed by Loiroma SAS. By using the Platform, the user contracts with both entities jointly for the purposes of this agreement.
The law applicable to these T&C is that of the Eastern Republic of Uruguay. Any dispute arising from the use of the Platform shall be submitted to the Ordinary Courts of the Department of Montevideo.
4. Registration and requirements for drivers
To register as a Driver on the Platform, the user must meet the following requirements:
- Be over 21 years of age.
- Hold a valid driver's license with at least one year of seniority. In the case of foreign drivers, a valid driver's license issued in their country of origin is sufficient.
- Complete the identity verification process on the Platform, which includes: a photograph of a valid driver's license, a photograph of a valid identity document, and a selfie verified through artificial intelligence confirming that the person in all three documents is the same.
- Have a valid payment method registered on the Platform. Debit and credit cards supported by the Stripe payment gateway are accepted. Prepaid cards are not accepted under any circumstances.
OlaCar reserves the right to reject, suspend or cancel Driver accounts when the data provided cannot be confirmed or when false, inaccurate or fraudulent information is detected.
4.1 Collection risk assessment
OlaCar operates an internal collection risk assessment system that analyzes the Driver's general financial profile based on their identity document, independently of their history on the Platform. This system considers factors such as payment history, outstanding charges, previous disputes, ratings received, the Driver's financial risk profile — including their capacity and historical behavior in paying traffic fines, tolls and additional charges generated in previous rentals — and other behavioral indicators recorded on the Platform.
If the system determines that a Driver presents a high level of risk, OlaCar may unilaterally and without prior justification: limit access to certain Platform features, require additional guarantees before confirming a booking, or suspend and block the Driver's account temporarily or permanently.
A blocked Driver may submit an appeal to OlaCar through the available support channels. OlaCar will assess the case and communicate its decision within 5 business days. OlaCar's decision shall be final within the scope of the Platform, without prejudice to the user's legal rights.
5. Requirements for hosts and vehicle conditions
To list a vehicle on the Platform, the Host must:
- Be the owner of the vehicle or have express authorization from the owner to make it available for rental.
- Guarantee that the vehicle is not subject to seizure, pledge, injunction, sale notice, or any measure that affects its free availability.
5.1 Maximum vehicle age
As required by the insurance policy contracted with SURA, only vehicles with a maximum age of 10 years counted from the year of manufacture may be listed on the Platform. OlaCar reserves the right to remove any vehicle that exceeds this limit without this giving rise to any right to compensation for the Host.
5.2 Technical inspection and mandatory maintenance
The Host must keep the vehicle in optimal mechanical condition and provide evidence of such maintenance to OlaCar. To this end, the Host must:
- Send proof of the most recent service to WhatsApp 091 872 872 when registering the vehicle on the Platform.
- Carry out maintenance services every 10,000 km or as recommended by the manufacturer, whichever occurs first, and send the corresponding proof to OlaCar each time it is performed.
If the Host cannot prove that maintenance is up to date at the time a mechanical failure occurs during a rental, the failure will be presumed attributable to lack of maintenance, and the Driver's account of events will take precedence in resolving the claim. In that case, the assistance and repair costs will be borne by the Host.
5.3 Listing conditions
When listing a vehicle on the Platform, the Host declares and warrants that the vehicle:
- Is in perfect mechanical and structural condition, fit to be driven safely by a third party.
- Has received adequate maintenance according to the manufacturer's recommendations.
- Has no known defects at the time of listing.
- Has all documentation in order, including the vehicle identification card, a valid SOA policy, mandatory technical inspection (where applicable) and all documentation required to circulate.
- Has at least two sets of keys in usable condition.
- Has all items required to circulate under Uruguayan regulations, including: first aid kit, spare wheel, jack and wheel wrench, emergency signaling (warning triangles), triclass fire extinguisher and any other item required by current regulations.
5.4 Rental price
The Host is responsible for setting the rental price of their vehicle. OlaCar may make price suggestions based on booking behavior and Platform demand, but the final decision on price rests exclusively with the Host.
The Host may configure variable prices according to the day of the week, time of day, season or other criteria they consider relevant. These price variations are valid and binding once published on the Platform.
Once the Host approves a booking, the agreed conditions — including price, duration, delivery method and any other agreed condition — become fixed and may not be unilaterally modified by the Host. The Driver booked under those conditions and is entitled to have them respected.
The Driver is responsible for verifying the total rental price — including any variation by day or time — before confirming and paying for the booking. Confirmation of the booking implies acceptance of the price displayed at that moment, with no possibility of subsequent claims regarding correctly published rate variations.
6. OlaTrack device
OlaTrack is the proprietary technology device developed by OlaCar that turns any vehicle into a connected car. Once installed, it allows the vehicle to be managed entirely remotely and digitally, without the need for in-person key handover or manual coordination with the Driver.
6.1 OlaTrack features
The OlaTrack device offers the Host the following features:
- Remote locking and unlocking of the vehicle from the Platform, enabling the Driver to pick up the car without physical keys.
- Remote immobilization of the vehicle, allowing the Host or OlaCar to block ignition in situations of risk or breach.
- Real-time telematics: GPS location, speed, fuel level, mileage and ignition status throughout the entire rental.
- Automated digital check-in and check-out, eliminating the manual vehicle handover and return process.
- Driving score per driver: a record of each Driver's driving behavior, including accelerations, braking and maximum speed.
- Trip history and automatic reports accessible from the Host's dashboard.
- Real-time alerts for events such as leaving the permitted area, harsh braking or speeding.
6.2 Usage recommendation
While installing the OlaTrack device is not mandatory in order to list a vehicle on the Platform, OlaCar strongly recommends its use. The device gives the Host full visibility and control over their vehicle during each rental, significantly reduces operational risks and reinforces the safety of every booking for both Host and Driver.
Vehicles with OlaTrack installed offer the Driver a fully digital experience — no keys, no waiting, no counters — which translates into greater demand and better ratings for the Host.

6.3 Host obligations regarding the device
A Host with the OlaTrack device installed may not remove it, disconnect it or interfere with its operation without OlaCar's express authorization. Any unauthorized intervention will be considered a serious breach of these T&C and may result in the immediate suspension of the account and the removal of the listed vehicles.
The presence of the OlaTrack device is not an excluding requirement for claims to be recognized. Coverage will apply in accordance with the general conditions of the policy in force with SURA.
7. Vehicle data processing and telematics consent
In compliance with Law No. 18,331 on the Protection of Personal Data of the Eastern Republic of Uruguay, OlaCar informs that the OlaTrack device installed in each vehicle continuously collects operating data during rentals. This data may include, among others: real-time location, speed, acceleration, mileage travelled, fuel level, ignition status and technical diagnostics of the vehicle ("Vehicle Data").
By accepting these T&C, both the Host and the Driver give their express, free and informed consent to the collection, storage and use of the Vehicle Data by OlaCar for the following purposes:
- Verify the correct use of the vehicle during the rental.
- Manage claims, disputes and complaints between the parties.
- Ensure the validity and applicability of insurance coverage.
- Improve the experience and safety of the Platform.
Vehicle Data will not be transferred to third parties except where necessary for the management of insurance with SURA, compliance with a court order, or the protection of the rights of the parties involved in a claim.
The Driver is responsible for informing their passengers that the vehicle has this monitoring system active throughout the entire rental.
8. Booking process
To make a booking, the Driver must select their preferred vehicle using the filters available on the Platform (area, vehicle type, rental dates and delivery and return method).
Once the request has been sent, the Host has up to 8 hours to accept or reject it. The Driver is charged at the moment they make the booking. If the Host rejects or cancels the booking, the amount paid is automatically refunded to the Driver with no further action required. Once the booking is confirmed, OlaCar will make the Host's contact details available to the Driver so that they can directly coordinate the details of the vehicle handover.
Price modifications must be managed exclusively through the Platform. Price agreements made outside it, whether verbally or by any other means, will not be recognized or supported by OlaCar and will not create rights or obligations for either party vis-à-vis the Company.
For other agreements between Host and Driver — such as handover coordination, schedules or other operational details — OlaCar may consider external written communications (for example, WhatsApp messages) as evidence for the purposes of mediating a dispute, without this implying any obligation for OlaCar to recognize or enforce such agreements.
If the Host and Driver need to change the vehicle pick-up or return location, they may agree on it directly between themselves. If they do not reach an agreement, OlaCar may intervene as mediator. In the absence of agreement, the pick-up or return location originally agreed in the booking shall prevail.
9. Additional driver
The vehicle may only be driven by the Main Driver who made the booking, unless an Additional Driver has been registered and validated before the start of the rental.
To enable an Additional Driver, the Main Driver must manage it directly from the Platform, accessing their booking and inviting the proposed driver from the "Additional drivers" section. The invited driver must register on the Platform using the email address to which they were invited, complete the registration process and pass identity verification, meeting the same requirements demanded of any driver. Authorization is effective only when the Platform shows the Additional Driver as confirmed.
The Main Driver is solely responsible before OlaCar, the Host and third parties for any event occurring during the booking period, including traffic offences, damage to the vehicle, accidents, fines and any other incident, regardless of who was driving the vehicle at that moment. Authorizing an Additional Driver does not release the Main Driver from that responsibility.
If it is established that an unauthorized person drove the vehicle, a UYU 2,000 penalty will be applied to the Main Driver, insurance coverage will be void for any claim occurring during that period, and the Main Driver will assume full liability for the damage caused. OlaCar is authorized to charge the payment method registered in the booking.
10. Vehicle handover and return
The Host must deliver the vehicle to the Driver at the place, date and time agreed in the booking, together with:
- One set of vehicle keys.
- A copy or the original of the vehicle's ownership booklet.
- A copy or the original of the vehicle identification card.
- A copy of the valid SOA insurance policy.
- First aid kit, regulation warning triangle, spare wheel, jack and one-kilo triclass fire extinguisher, in accordance with Uruguayan regulations.
The Host should preferably deliver the vehicle with a full fuel tank. The Driver must return it in the same condition in which it was received.
The Driver must present their identity card and valid driver's license when picking up the vehicle. The Host may refuse to hand over the vehicle if the Driver does not meet these requirements, is not the person identified in the booking, or shows signs of not being fit to drive.
The Driver must return the vehicle in the same cleanliness and fuel conditions in which it was received. If the vehicle is returned dirty, a UYU 800 cleaning charge will be applied, an amount that is passed on in full to the Host. If fuel is missing, UYU 90 per missing liter will be charged to restore the delivery level.
10.1 Mandatory photographic record
At the start of each rental, the Driver must complete the photographic record of the vehicle following the flow guided by the Platform, which covers all profiles of the vehicle. This record has evidentiary value in determining the condition of the vehicle before the rental.
If the Driver does not complete the photographic record at the start, a UYU 500 penalty will be applied and the vehicle will be presumed to have been delivered without visible damage. In any subsequent dispute, the Driver may not claim pre-existing damage. The Host is also responsible for requiring the Driver to complete the photographic record both at the start and at the end of the rental. If the record is not completed, OlaCar may apply the penalty to both parties equally, since the responsibility for ensuring compliance with this process is shared.
At the end of the rental, the Driver must complete the same photographic record when returning the vehicle. The Host has 24 hours from the return to report damage or defects to the vehicle, and 72 hours to report missing fuel, tolls or cleaning charges. Once these deadlines have passed, the Host loses the right to claim for those items.
It is extremely important that the Driver completes the photographic record when returning the vehicle. This record is their main line of defense against any subsequent claim by the Host. If the Driver does not take the closing photos and the Host claims damage, a scratch, missing fuel or another defect, the Driver will have no evidence to refute that claim and OlaCar will have to resolve the dispute with the information available, which may be unfavorable to the Driver. Closing photos protect the Driver as much as the Host.
10.2 Fuel charge (OlaGO)
In bookings under the OlaGO modality, the fuel consumed during the trip is settled at closing. The charge is calculated as the difference between the fuel level confirmed at the start and the level confirmed when returning the vehicle, multiplied by the tank capacity and by the current fuel price. If you return the vehicle with the same or more fuel than recorded at the start, no charge is generated. Level differences below a minimum tolerance set by the Platform are not charged. The resulting amount is retained by the Platform at the time of closing.
10.3 Return within the delivery area (OlaGO)
In bookings under the OlaGO modality, the vehicle must be returned within the delivery area assigned to that vehicle. The trip cannot be ended while the telematics device detects that the vehicle is outside that area: the booking will remain active and the cost will continue to accrue until the vehicle returns to the delivery area and the closing is completed.
11. Cancellations
11.1 Cancellation by the Driver
The Driver may cancel a booking without penalty up to 72 hours before the start of the rental. Cancellations made less than 72 hours in advance will incur a UYU 2,000 charge in favor of the Host.
If the Driver does not show up without having cancelled beforehand (no-show), 100% of the booking value will be charged with no right to a refund.
11.2 Cancellation by the Host
If the Host cancels a booking less than 24 hours in advance, OlaCar will apply a UYU 2,000 penalty, an amount that will be paid in full to the Driver as compensation.
In the event of cancellation by the Host, OlaCar will offer the Driver, subject to availability, an alternative vehicle of similar characteristics or a full refund of the amount paid. The refund is processed by OlaCar automatically and immediately. However, the time it takes for the Driver to see the money reflected in their bank account depends exclusively on the bank that issued their card and may vary from immediate credit to several business days. OlaCar has no responsibility for those timeframes and cannot intervene in the banking process.
12. Commissions
OlaCar charges the following commissions for intermediation, use of the technology and operational support, calculated on the base rental price set by the Host:
- Driver: 10% of the base rental price.
- Host: 15% of the base rental price.
In addition, each booking includes a daily insurance charge corresponding to the coverage described in Clause 13. The amount corresponding to the Driver is itemized in the booking details before payment is confirmed, and the amount corresponding to the Host is deducted from their payout. Current amounts are published on the Platform and may vary by city.
These commissions will be deducted automatically at the time each booking is settled. OlaCar reserves the right to modify the commissions with prior notice to users through the Platform.
12.1. Pay later (Book now, pay at pick-up)
When the Host enables payment at pick-up ("Book now, pay later"), the Driver pays online at the time of booking the full amount of OlaCar's commissions and insurance (both the Driver's and the Host's) plus the security deposit. When picking up the vehicle, the Driver pays the Host directly only the net amount corresponding to the Host, according to the agreed payment instructions. OlaCar does not transfer that amount to the Host, since the Host already receives it directly.
12.2. Host settlement
Each booking is settled independently. The base amount corresponding to the Host — the rental value less OlaCar's commission and insurance — is released at the end of the trip, once the booking has been closed by both parties. Additional charges approved by the Host after the trip (for example, damage or fuel) are settled as they are approved. Crediting times in the Host's account may depend on the payment processor.
13. Insurance and coverage
Rentals carried out through the Platform are covered by an insurance policy in force contracted by OlaCar with SURA. OlaCar is not an insurance company and does not directly insure Hosts or Drivers.
The policy covers rentals exclusively during the active period recorded on the Platform, and provided that the Driver has complied with these T&C. Breach of the T&C — including use of the vehicle for paid transport services, driving under the influence of alcohol or substances, or handing the vehicle over to unauthorized drivers — will automatically void coverage.
13.1 Main conditions of the policy in force
The main conditions of the contracted coverage are as follows:
- Product: Full Coverage.
- Policy deductible: USD 700 — the deductible set by SURA in the policy in force.
- Claim handling fee: USD 200 — charged by OlaCar for the administrative handling of the claim, in addition to the deductible.
- Total payable by the Driver: USD 900 — where the claim is the Driver’s responsibility, the Driver authorizes OlaCar to charge USD 900 (USD 700 deductible plus USD 200 handling fee) to the card used to pay for the booking. Where the claim is not the Driver’s responsibility, neither the deductible nor the handling fee is charged to them.
- Determination of fault: made by the insurer based on its assessment of the claim. Where the police or traffic authority has intervened, the corresponding report is taken into account in that determination.
When confirming the booking, OlaCar holds UYU 2,000 as a security deposit to cover minor expenses such as tolls, cleaning or missing fuel. This amount is returned to the Driver when the booking closes if there are no outstanding charges.

13.2 Exclusions
- No coverage is provided outside Uruguay.
- Coverage does not include Glass, Windshields, Locksmith services or Theft from the Trunk.
- The USD 700 deductible applies to claims covered by the policy; damage below the deductible is not covered and is borne by whichever party is responsible under these T&C.
14. Mechanical failures, claims and incidents
Any incident occurring during the rental — accident, damage, theft, mechanical failure, or any event affecting the integrity of the vehicle or of third parties — must be reported immediately to OlaCar via WhatsApp 091 872 872, available 24 hours a day, 7 days a week. This number operates exclusively via WhatsApp and does not take phone calls. All communication must be in writing to leave a record of the incident. OlaCar will guide the Driver through the steps to follow, including coordination with SURA Seguros where applicable.
For direct insurance assistance, SURA can be contacted at 0800 8120 ext. 1 from Uruguay, available 24 hours a day.
In the event of a mechanical failure, the Driver must:
- Stop the vehicle in a safe place.
- Contact the Host immediately to report the situation.
- If the Host does not respond or cannot resolve the situation within a reasonable time, contact OlaCar via WhatsApp 091 872 872.
Roadside assistance carries no additional cost for the parties, as it is included in the insurance policy in force. However, the cost of the repair will be assigned according to the cause of the failure:
If the failure is the Host's responsibility — due to normal wear, lack of maintenance or undisclosed pre-existing problems — the cost of the repair will be borne by the Host. OlaCar may deduct that amount from future settlements.
If the failure is the Driver's responsibility — due to proven misuse of the vehicle — the cost will be borne by the Driver. OlaCar is expressly authorized to charge it directly to the payment method registered in the booking, without the need for additional authorization.
Indications of vehicle misuse by the Driver include, among others: ignoring dashboard warnings, using the wrong fuel, abusive driving or repeated harsh accelerations, overloading with passengers or cargo, and failing to report a failure in time, thereby aggravating the damage.
In the event of an accident involving third parties, the Driver must collect the third party's details: full name, contact number, vehicle license plate and insurance policy number. Missing this information may prevent the deductible from being waived.
In the event of a dispute over the cause of the failure or claim, OlaCar may require an independent technical diagnosis before assigning the charge. OlaCar's decision will be binding on both parties, without prejudice to each party's right to challenge it through the appropriate legal channels.
The Driver may not carry out repairs on their own without prior authorization from the Host and OlaCar. Unauthorized expenses will not be recognized by either party.
The Host has 24 hours from the return of the vehicle to report damage not disclosed by the Driver. Once this deadline has passed, the Host may not claim for that damage.
OlaCar will work with SURA and official network workshops to manage repairs. No specific repair timeframes are guaranteed, as they may depend on external factors such as parts availability.
15. Vehicle use conditions
The Driver undertakes to use the vehicle responsibly and in accordance with Uruguayan traffic regulations. The following is expressly prohibited:
- Allowing persons not authorized by OlaCar to drive the vehicle.
- Smoking any type of substance inside the vehicle, including cigarettes, marijuana or any similar product.
- Transporting animals without the Host's express authorization.
- Using the vehicle to take part in competitions, races or activities involving extreme use.
- Transporting illegal, dangerous or flammable substances.
- Driving under the influence of alcohol, drugs, medication or any substance that affects the ability to drive.
- Making modifications to the vehicle without the Host's authorization.
- Using the vehicle to tow other vehicles or loads.
- Overloading the vehicle beyond its official passenger or cargo capacity.
15.1 Prohibition of use for paid transport
It is expressly prohibited to use a vehicle rented through OlaCar to provide paid passenger transport services through intermediation platforms or applications, including but not limited to any transport intermediation platform or application.
Breach of this prohibition will have the following consequences: immediate cancellation of the rental with the Driver's obligation to return the vehicle at that moment, retention of 100% of the amount paid for the rental with no obligation to refund the unused portion, total loss of insurance coverage, suspension or permanent cancellation of the Driver's account, and the Driver's liability for all damage caused to the vehicle, to third parties and to the Host, without limit. OlaCar will be authorized to charge the damages to the registered payment method.
16. Penalties and charges for breach
OlaCar may apply the following charges to the Driver or the Host as applicable. All amounts will be automatically debited from the payment method registered on the Platform. An additional 10% will be applied to the total of each charge for administrative expenses in favor of OlaCar.

(*) Missing fuel is calculated based on the liters needed to bring the tank back to the delivery level, at a rate of UYU 90 per liter of petrol. The claim must be submitted within 72 hours of the return with photographic evidence of the fuel level.
In the event of a disagreement about any charge, the parties may submit their appeal to OlaCar within 48 hours of being notified of it.
17. Tolls and traffic fines
The Driver is responsible for all tolls and traffic fines incurred during the rental period. If the vehicle records fines or toll debts, the Host may report them to OlaCar within 2 months of their publication in SUCIVE. OlaCar will manage the charge to the Driver through the registered payment method.
The charge for fines will include the value of the fine plus a 10% administrative charge in favor of OlaCar. Tolls are charged at the price published in SUCIVE, with no additional administrative charge.
18. Listings and special Host conditions
The Host may establish special conditions for rentals, provided they do not contradict these T&C or constitute unjustified discrimination contrary to the law. By way of example, the Host may establish that the vehicle does not allow pets, smokers or other reasonable conditions.
Breach of the special conditions established by the Host will give rise to a 2 U.R. penalty for the Driver, plus the 10% administrative charge.
19. Ratings
At the end of each rental, Drivers and Hosts may rate each other. Ratings are public and form part of each user's profile. OlaCar reserves the right to edit or delete ratings considered inappropriate, offensive or fraudulent, and to suspend or close accounts that accumulate repeated negative ratings.
20. Personal data protection
OlaCar processes its users' personal data in accordance with Law No. 18,331 on the Protection of Personal Data of Uruguay and its implementing decree. The data collected will be used exclusively for account management, service provision, insurance management with SURA and compliance with legal obligations.
OlaCar will not transfer personal data to third parties except as mentioned in the previous paragraph or when required by court order. Users may exercise their rights of access, rectification, updating and deletion of data through the Platform's support channels.
21. Limitation of liability
OlaCar acts exclusively as a technological intermediary and is not a party to the rental contract between Host and Driver. OlaCar does not guarantee the identity, solvency, conduct or legal capacity of users, nor the truthfulness of the information they publish on the Platform.
Under no circumstances will OlaCar be liable for indirect damages, loss of profit or any other harm arising from the use of the Platform or from rentals arranged through it, except in cases of willful misconduct or gross negligence directly attributable to OlaCar.
OlaCar's maximum liability towards any user, for any cause, is limited to the amount of the commission received on the booking that gave rise to the claim.
22. Modification of the Terms and Conditions
OlaCar reserves the right to modify these T&C at any time. Modifications take effect from the moment they are published on the Platform. OlaCar will indicate the date of the last update in the document, which will be permanently and freely available to any user. Continued use of the Platform implies acceptance of the T&C in force at the time of each booking.
23. Jurisdiction and applicable law
These T&C are governed by the laws of the Eastern Republic of Uruguay. For any dispute arising from the use of the Platform, the parties agree to submit to the exclusive jurisdiction of the Ordinary Courts of the Department of Montevideo, waiving any other jurisdiction that might apply to them.
